As with any licensed professional, attorneys in Iowa are required to provide their clients with the care and skill that is commonly possessed and exercised by other attorneys under similar circumstances. In some cases, the standard of care required by an attorney is set forth in the Iowa Code of Professional Responsibility. In other cases, the care required by an attorney must be determined by careful consultation with an attorney who is qualified to practice in the same area of law. If an attorney fails to follow the required care, diligence and skill that is called for, and that failure results in harm to you, it may be the basis for a legal negligence or malpractice claim against that attorney.
Generally, a legal malpractice claim is based upon the attorney’s failure to meet the required standard of care. A legal malpractice claim may also be based upon a breach of contract, breach of fiduciary duty, fraud or violation of deceptive trade practice law. If it can be proven that legal malpractice occurred and that you would have had a better or more favorable outcome in your original case if the malpractice had not occurred, you may be entitled to recover damages from the negligent attorney. However, challenging an attorney in court is a task that requires a thorough understanding of the legal issues involved.
At Ball, Kirk & Holm, P.C., our legal malpractice attorneys have broad experience with negligence actions, and a deep appreciation of the standards that govern our profession. We are dedicated to maintaining the propriety of the legal profession as well as the public image of lawyers in general.
